Challenge:
As of summer 2014, the requirements for the manufacture of structures and structural steelwork specified in this standard will be mandatory for all manufacturers of steel and aluminum structures. This standard was originally intended to be introduced until 2012, but was postponed for a transitional period.
In addition, parts of the standard ISO 3834, EN 287 Welding tests and the availability of a welding supervisor as well as welding processes and corresponding welding power sources must be provided in addition, if you have not yet obtained them. In addition, several components must comply with an ISO 9001 and EN 3834 certification

The test and warning obligation states that a contractor has to check the documents provided to him for completeness and correctness, if he can.
It is therefore not an "EN 1090 duty", but the duty of the examination of foreign documents, plans, materials, etc. in the context of a construction work.
Due to the fact that it is a harmonized standard, EN 1090 is legally binding and of course has long been regarded as a "recognized rule of technology".
The duty to inspect and warn in Austria is a duty of contractors for construction works. The obligation laid down in ÖNORM B 2110 (General Contract Terms for Works - Contract Work Standard) means that an entrepreneur must review the execution documents, instructions, materials or inputs provided by the client. The customer must be informed in writing of any defects or expected damages. If the entrepreneur fulfills his test and warning obligation, and the client instructs the unaltered execution or does not make a decision, the entrepreneur is released from his liability and warranty in the corresponding case of damage.

Even though there will be no real regulatory body controlling the market and the products placed on the market until the end of the coexistence period of EN 1090-1, ignoring EN 1090-2 even before the cut-off date in the event of damage is a safe break for the manufacturer ,
